Injured mechanic to receive R2,5 million

A diesel mechanic who was seriously injured when a heavy rotary mower fell on him in 2009 will receive R2,5 million from the owner of the property where the accident happened.
The case was settled between the parties this week.
Pietermaritzburg High Court judge Sharmain Balton endorsed a consent order in terms of which property owner Noel Godwin will pay injured mechanic Errol Wayne Swiegers R2,5 million in damages, plus legal costs. He will also cover the costs of experts who were consulted in connection with the case.
The high court heard evidence as far back as 2013 aimed at determining if Godwin should be held liable for the injuries that Swiegers sustained on February 23, 2009.
According to the evidence before the court Swiegers, of Wayne's Mechanical Services, missed six months' work after the accident.
Thereafter he returned to work, but only on a limited basis. He said he was no longer able to perform physical work due to the severity of the back injuries he sustained.
Swiegers said he had to employ extra staff to help him run his business and this cost him almost half of what he previously earned.
The accident happened when Swiegers was called out to Godwin's Kwambonambi premises to repair a rotary mower (or slasher).
According to evidence, while he was busy inspecting the gearbox, one of Godwin's employees got into the tractor (to which the mower was attached) and pressed the clutch pedal.
His actions dislodged the mower and caused it to fall and crush Swiegers.
Swiegers was allegedly knocked unconscious for about 30 minutes and suffered excruciating pain.
He suffered injuries to his spine which needed surgery

Senior Director Ronald Bobroff holds many qualifications including Bachelor of Arts, Law and Psychology, University of the Witwatersrand; Bachelor of Laws, University of the Witwatersrand; Australian Legal Practice Admissions Board; Israeli Bar - as well as other foreign qualifications.
He is also admitted to practice in Australia.
His extensive knowledge of the law, together with an ability to convey difficult issues in simple language led to him being headhunted to host his own radio talk show for the past 10 years on Talk Radio 702, Monday evenings from 7pm - 9pm. Similarly, he also regularly hosts and appears on prime time TV talk shows including Carte Blanche, SABC Interface, the News and Nolene on 3 Talk.
His encyclopaedic knowledge of medicine and medico-legal issues was reflected in his monthly column in the Medical Chronicle Journal. He has also been invited to present lectures to the University of the Witwatersrand Medical school faculty heads, as also to the Department of Bioethics affiliated to the medical school.
He also was invited to present an address at the Africa Health and Ethics conference which was attended by leading international medical practitioners, as also to the South African Theatre Nurses Association annual convention. He writes regularly for Health and Wellness magazines on medical issues.
